It does not cover the systems we build for you under a separate engagement contract. Those are governed by the master services agreement (MSA) and statement of work (SOW) we sign with you. If anything on this page contradicts the MSA, the MSA wins.

When you send us anything — a brief, a screenshot, a Loom, a code snippet, a deck — you keep ownership of it. Sending it to us gives us a limited license to read it, share it internally on the team, and reference it while we figure out whether and how to work together.
We will not publish, republish, or distribute your submissions without your written permission. If you want a written NDA before sharing something sensitive, ask — we'll usually sign one.

We work in healthcare, but this is a marketing site. Nothing on it — including any blog post, case study, statistic, or capability description — is medical, legal, financial, or clinical advice.

Browsing this site does not create a client relationship. A client relationship begins when we both sign a master services agreement and a statement of work — and that paperwork governs the rest of the engagement, including:

We update, redesign, occasionally break, and sometimes take down parts of this site. We try not to break things. We make no specific uptime promise on this marketing site.
Production work for clients has SLAs documented in the engagement contract. Those are real promises, with real teeth.
The site is provided as-is and as-available. To the fullest extent allowed by applicable law, we disclaim all warranties, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the fullest extent allowed by law, 42degrees and its team will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the site, even if we've been advised of the possibility of such damages.
Our total liability arising out of your use of this marketing site, across all claims, is capped at one hundred US dollars. (Real engagement work has its own liability terms in the contract.)
These terms are governed by the laws of the State of Texas, USA, without regard to its conflict-of-laws rules.

If a dispute can't be resolved by talking within 60 days, both parties agree to binding arbitration administered under the rules of the American Arbitration Association, conducted in Travis County, Texas or remotely. You and 42degrees both waive any right to a jury trial. Class actions and class arbitrations are not how disputes are resolved under these terms.
We update the date at the top of this page when we change anything here. For material changes, we'll put a notice on the homepage for 30 days. Continuing to use the site after a change means you accept the new version.
